1. Acceptance
By downloading or using Elegant Planner, you agree to these terms. Apple's Standard Licensed Application End User License Agreement also applies to the iOS app. Mandatory store and consumer-protection terms control if they conflict with these terms. If you do not agree, do not use the app.
2. Provider
Elegant Planner is provided by Elegantmind LLC, a Texas (USA) limited liability company, 2310 N Henderson Ave, Ste B, Dallas, TX 75206-7388, United States ("Elegantmind," "we," "us").
3. Eligibility
You must be able to form a binding contract where you live, or have the consent of a parent or legal guardian, to use Elegant Planner. The app is not directed to children.
4. Service
Elegant Planner provides local-first task planning, reminders, focus tools, templates, statistics, and related productivity features. Features vary by platform and version.
5. License
Elegantmind grants a limited, non-exclusive, non-transferable, revocable license to install and use the app for personal or internal business productivity, subject to store terms.
6. Your content
You retain rights to tasks, notes, and other content you create. You are responsible for device security and backups. Local deletion or uninstalling may be irreversible. If you enable iCloud Sync, your supported planner content is also subject to your Apple Account and Apple's iCloud terms.
7. Pro subscriptions
Eligible users may purchase monthly or annual Elegant Planner Pro through Apple's App Store. Before purchase the app displays the subscription name, the price in your local currency together with its billing period, the included features, and — where you are eligible — that the first seven days are free and what the price becomes when the trial ends. Payment is charged to your Apple Account. Subscriptions renew automatically for the same billing period unless cancelled through your App Store account settings. You can restore eligible purchases and open Apple's subscription-management screen from the app. Apple handles billing, cancellation, taxes, and refund requests under its terms. Removing the app does not cancel a subscription.
If you cancel or a subscription lapses, Pro features switch off at the end of the period you have already paid for. Nothing is deleted: the free planner keeps working and your tasks, notes, templates, and history remain on your device exactly as they were.
If we change the price of a subscription, Apple will ask for your consent before any new price is charged, and the subscription will not renew at the new price without it. You can cancel at any time before that.
8. iCloud Sync
Optional Pro iCloud Sync is off until you enable it. It uses Apple's private CloudKit database to synchronize supported planner fields across Apple devices signed into your Apple Account. You can turn synchronization off without deleting local tasks. Existing cloud records are removed separately using the app's “Remove Data from iCloud” action. Synchronization can be delayed or unavailable because of network, storage, account, or Apple service conditions.
9. Acceptable use
Do not misuse the app, attempt unauthorized access, interfere with service integrity, remove proprietary notices, or use the app unlawfully.
10. Intellectual property
Elegant Planner, its visual identity, software, and website are owned by Elegantmind or its licensors. These terms do not transfer ownership.
11. Availability and updates
We may improve, modify, or discontinue features and may require updates for security, compatibility, or store compliance. Paid access already earned for the applicable subscription period will be handled according to Apple terms and applicable law.
12. Disclaimer
To the maximum extent permitted by law, the app is provided "as is" and "as available," without warranties of uninterrupted or error-free operation.
13. Limitation of liability
To the maximum extent permitted by law, Elegantmind is not liable for indirect, incidental, special, consequential, or punitive damages arising from app use.
14. Governing law and disputes
These terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-law rules. Subject to any mandatory consumer-protection rights you hold where you live, you and Elegantmind submit to the exclusive jurisdiction of the state and federal courts located in Texas for disputes not otherwise resolved. Nothing here limits non-waivable statutory rights.
15. Changes
Material changes will be identified by the effective date and, when appropriate, communicated in the app.
16. Copyright complaints
If you believe material on this website or in the app infringes your copyright, write to info@elegantmind.ai with the work concerned, where it appears, your contact details, and a statement that you hold the rights or act for the rights holder. We remove infringing material promptly.
17. Your statutory rights
Nothing in these terms limits or excludes any rights you have under the consumer law of the country where you live that cannot be waived by agreement. Where such law conflicts with these terms, that law applies. Purchases are made from Apple, so Apple’s refund and withdrawal processes apply in addition to any rights you have by law.
18. General
If any provision of these terms is held unenforceable, the rest continue in force. We may assign these terms to a successor in connection with a merger, acquisition, or sale of assets; you may not assign them without our written consent. These terms, together with the Privacy Policy and any store terms that apply, are the entire agreement between you and Elegantmind about Elegant Planner, and replace any earlier understanding. A delay in enforcing a term is not a waiver of it.
